These Terms & Conditions ("Terms") govern your access to and use of the Soul Streetwear Co website ("Site"), and the purchase of products from us. By accessing, browsing, or placing an order on this Site, you agree to be bound by these Terms.

1. About Us

Soul Streetwear Co is an online streetwear brand operating on a print-on-demand (POD) model. We use third-party production and fulfilment partners including (but not limited to) Gelato and Printful, integrated through Shopify.

All products are made to order specifically for each customer.

2. Definitions

  • "We", "us", "our" refers to Soul Streetwear Co
  • "Customer", "you" refers to any person using the Site or purchasing products
  • "Products" refers to all items listed for sale on the Site
  • "POD" refers to print-on-demand manufacturing and fulfilment
  • "Site" refers to the Soul Streetwear Co Shopify store

3. Eligibility

You must be at least the age of majority in your jurisdiction, or have consent from a parent or guardian, to use this Site and place orders.

By using this Site, you confirm that all information provided is accurate and complete.

4. Account Registration (if applicable)

You may be required to create an account to place orders. You are responsible for:

  • Maintaining confidentiality of login credentials
  • All activities conducted under your account

We reserve the right to suspend or terminate accounts at our discretion if misuse or fraudulent activity is suspected.

5. Product Information & Print-on-Demand Model

All Products are:

  • Made to order (not pre-stocked)
  • Fulfilled by third-party production partners

Important notes:

  • Product images are digital mockups and may differ slightly from final physical items
  • Minor variations in colour, placement, stitching, or print quality may occur due to production processes
  • Sizing variations may occur between batches or garment types

We aim for accuracy in all product descriptions but do not guarantee that all content is error-free.

6. Orders

When you place an order:

  • You are making an offer to purchase Products
  • Orders are not accepted until payment is processed and confirmed
  • We reserve the right to refuse or cancel orders at any time (including suspected fraud, pricing errors, or stock/production issues)

Once production has started, orders cannot be changed or cancelled.

7. Pricing & Payment

  • All prices are displayed in the applicable currency at checkout
  • Prices may change without notice
  • You agree to pay all charges including product cost, shipping, and applicable taxes
  • We use third-party payment processors (e.g., Shopify Payments, PayPal). We do not store full credit card details.

In the event of pricing errors, we reserve the right to cancel orders and refund payments.

8. Shipping & Delivery

  • Delivery times are estimates only and may vary by destination and fulfilment partner
  • Orders are fulfilled by third-party partners (e.g., Gelato, Printful)
  • Tracking information will be provided once the order is dispatched

We are not responsible for delays caused by:

  • Couriers
  • Customs clearance
  • Weather events
  • Peak seasonal demand
  • Third-party fulfilment delays

International orders may be subject to customs duties or import taxes, which are the responsibility of the customer.

9. Cancellations & Amendments

Once an order has been placed:

  • It cannot be guaranteed to be modified or cancelled
  • If production has not started, we may attempt to assist upon request

We reserve the right to decline cancellation requests once fulfilment has begun.

10. Returns, Refunds & Consumer Guarantees (NZ Law)

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (NZ).

You are entitled to remedies if products are:

  • Faulty
  • Not as described
  • Damaged upon arrival

Because our Products are made-to-order:

  • We do not offer returns or refunds for change of mind, incorrect sizing, or buyer error

To request a return or replacement:

  • Contact us with order details and evidence (e.g., photos)
  • Claims must be made within a reasonable time after delivery

We may offer replacement, repair, or refund depending on the issue.

11. Third-Party Services

We rely on third parties including:

  • Shopify (platform)
  • Gelato / Printful (production & fulfilment)
  • Courier services (delivery)

We are not responsible for failures, delays, or errors caused by these third parties, but will assist in resolving issues where possible.

12. Risk & Title

Risk in Products passes to you upon delivery to the shipping address provided.

We are not responsible for lost or stolen parcels once marked as delivered by the courier.

13. Promotions, Discounts & Gift Cards

From time to time we may offer:

  • Discount codes
  • Promotional offers
  • Gift cards

Conditions apply to each promotion and may be changed or withdrawn at any time. Gift cards are non-refundable and cannot be exchanged for cash unless required by law.

14. Intellectual Property

All content on this Site including designs, logos, artwork, product images, and website content is owned by or licensed to Soul Streetwear Co and protected under intellectual property laws.

You may not copy, reproduce, distribute, or use any content without written permission.

15. Prohibited Uses

You must not:

  • Use the Site for unlawful purposes
  • Attempt to hack, disrupt, or damage the Site
  • Use automated systems to extract data
  • Resell or misuse our designs or content

16. Accuracy of Information

We aim to ensure all information is accurate, but we do not guarantee:

17. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • We are not liable for indirect, incidental, or consequential losses
  • Our total liability is limited to the amount paid for the relevant Product

Nothing in these Terms excludes liability where it cannot be excluded under NZ law.

18. Force Majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including:

  • Natural disasters
  • Strikes
  • Supply chain disruptions
  • System failures
  • Government restrictions

19. Privacy

Your personal information is handled in accordance with our Privacy Policy, which complies with the Privacy Act 2020 (NZ).

20. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

21. Changes to Terms

We may update these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.

22. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of New Zealand courts.
